1. Who We Are and Scope

XGEN Labs Limited ("XGEN", "we", "us" or "our") is a company incorporated in Hong Kong. This Privacy Policy describes our handling of personal data through websites and digital services expressly identified as being operated by XGEN Labs Limited, including our upcoming overseas AI-powered products (collectively, the "Services").

This Policy does not automatically apply to the general corporate website or services operated by a separately incorporated mainland China company, even if the same XGEN brand or domain is used. Please check the operator identified on the relevant page.

2. Current Pre-launch Status

Our overseas consumer product is under development, and beta testing is planned for November 2026. At present, the Services may be limited to product information, policy pages, pre-launch inquiries and other functions actually made available on our website. Features not yet released do not collect information merely because they are described here.

3. Personal Data You Provide

If you email us, submit an inquiry or use a beta-interest form if one is offered, we may receive your name, email address, contact details, the content of your message and any information you voluntarily include. We request only information relevant to the stated purpose.

Providing this information is generally voluntary. If you choose not to provide contact details, we may be unable to respond to you or send information you requested.

4. Technical Information and Cookies

When you visit our pages, web servers or hosting providers may generate technical records such as IP address, device or browser information, requested page, access time, security events and error logs. We use such records as reasonably necessary to operate, secure and troubleshoot the website.

Essential cookies or similar technologies may be used where required for the website to function. If we introduce non-essential analytics, advertising or tracking technologies, we will identify them and provide any notice or choice required by applicable law.

5. Data That Future Product Features May Process

When our products launch, features such as account registration, AI conversations, user profiles, uploaded images, personalization or social interaction may require additional categories of data. Depending on the actual feature, these could include a chosen username, preferences, voluntarily supplied biographical details, uploaded media, messages and interaction history.

Some information a user chooses to provide may be sensitive. We will not treat all these potential categories as currently collected. Before enabling a relevant feature, we will explain what data it collects, why it is needed, whether provision is required, how it is used and any additional choices or safeguards.

• Responding to inquiries, requests and support messages.

• Operating, maintaining and securing the relevant website.

7. Product Updates and Direct Marketing

We may send service-related responses or notices requested by you. We will not use your personal data for direct marketing without satisfying applicable notice and consent requirements. You may ask us to stop promotional emails at any time via the contact address below.

8. Sharing and Service Providers

We may disclose limited information to hosting, security, email, customer support or other technology providers acting on our behalf; professional advisers; and authorities where disclosure is legally required. We require appropriate confidentiality and data-protection arrangements when engaging service providers.

The independently incorporated mainland China company is not automatically the controller or recipient of data collected by XGEN Labs Limited. If data sharing with that company or other entities is introduced, we will disclose the parties, purposes and relevant safeguards as required by law.

9. AI Providers and Model Training

Some future features may use external AI infrastructure or model providers to process inputs and deliver requested functionality. Before those features are activated, we will provide applicable information about data categories, provider roles and processing practices.

We will not introduce use of personal data for AI model training or improvement without providing the notices, choices and consents required by applicable law. This statement does not describe a product training setting that is already available.

10. International Processing

Depending on the infrastructure and providers selected for a particular Service, data may be processed outside Hong Kong. Before launching features that involve such processing, we will provide relevant information and implement safeguards required by applicable law.

11. Retention and Disposal

We keep personal data only for as long as reasonably needed for the disclosed purpose or as required by law. Relevant factors include the nature of a request, security needs and legal obligations. When data is no longer needed, we take reasonable steps to delete, de-identify or securely dispose of it.

12. Information Security

We apply reasonable organizational and technical measures designed to reduce unauthorized access, accidental loss, misuse or disclosure. No online service can guarantee absolute security. Please avoid submitting passwords, payment-card details or unnecessary sensitive information by ordinary email.

13. Your Rights and Choices

Subject to applicable law, you may request access to and correction of personal data we hold about you. You may also ask about deletion, withdrawal of consent or stopping direct-marketing communications where applicable. We may verify your identity before responding and may retain data where legally required.

Send privacy requests to admin@xgenlabs.ai. If our future app supports account creation, we will provide account-deletion options consistent with applicable platform and legal requirements before that feature is made available.

14. Children

The pre-launch website is not intended to knowingly solicit personal data from children in violation of applicable law. We will state the age eligibility and any additional protections for our interactive product before beta access is offered.

15. Changes to This Policy

We may revise this Policy when actual features, practices or applicable legal requirements change. The latest version will be published on the relevant product page with an updated date. Where required, we will give additional notice or request consent before materially different uses of personal data begin.

即使使用相同的 XGEN 品牌或域名，本政策也不自动适用于由另一个中国大陆独立法人运营的企业官网及服务。请以相关页面明确列出的运营主体为准。

2. 当前产品阶段

我们的海外消费者产品仍在开发中，计划于 2026 年 11 月启动内测。目前的服务可能仅包括产品信息、政策页面、上线前咨询及网站实际提供的其他功能。尚未推出的功能不会仅因本政策提及而自动收集资料。

3. 您主动提供的个人资料

如果您向我们发送邮件、提交咨询，或使用实际开放的内测意向登记表，我们可能收到您的姓名、电子邮箱、联系方式、留言内容以及您自愿提供的其他信息。我们仅应要求与所述用途相关的资料。

提供上述资料通常属于自愿行为。如果您不提供必要的联系方式，我们可能无法回复咨询或发送您主动请求的信息。

中国大陆独立法人并不会自动成为 XGEN Labs Limited 所收集资料的控制者或接收方。如果未来需要与该公司或其他实体共享资料，我们将依照适用法律披露相关方、共享目的及保障措施。

9. AI 服务提供商与模型训练

未来部分功能可能使用第三方 AI 基础设施或模型服务商处理输入内容并提供相关功能。在启用这些功能前，我们会适当说明涉及的数据类别、服务商角色和处理方式。

如未来拟将个人资料用于 AI 模型训练或改进，我们将先履行适用法律要求的告知、选择与同意程序。本说明不代表目前已经提供某项模型训练设置。

10. 跨境处理

根据具体服务所采用的基础设施及服务商，资料可能在香港以外地区被处理。相关功能推出前，我们将提供必要信息并采取适用法律要求的保障措施。

11. 资料保存与处置

我们仅在实现已告知目的所合理需要的期间或法律要求的期间内保存个人资料。保存期限取决于请求性质、安全需要及法律义务等因素。资料不再需要时，我们会采取合理措施进行删除、去标识化或安全处置。

12. 信息安全

我们采取合理的管理及技术措施，以降低未经授权访问、意外丢失、滥用或泄露的风险。任何线上服务均无法保证绝对安全。请勿通过普通邮件发送密码、支付卡完整信息或不必要的敏感资料。

13. 您的权利和选择

在适用法律规定的范围内，您可以请求查阅及更正我们持有的个人资料；也可以就删除资料、撤回同意或停止直接促销提出请求。处理相关请求前，我们可能需要核实身份；法律要求保留的资料可能无法立即删除。

隐私请求请发送至 admin@xgenlabs.ai。如果未来 App 支持注册账号，我们会在相关功能上线前按适用平台规则及法律要求提供账号删除机制。

14. 未成年人

预上线网站不以违反适用法律的方式主动向未成年人收集个人资料。提供内测访问前，我们会公布互动产品的适用年龄要求及必要的额外保护措施。

15. 政策更新

如实际功能、处理方式或法律要求发生变化，我们可能修订本政策。最新版本将在相应产品页面公布并更新日期。如个人资料使用方式发生重大变化，我们将依照适用法律另行通知或征求同意。
